About Us

The National Institutes of Health (NIH) and the Department of Health and Human Services (DHHS)wide Infrastructure Investment and Jobs Act (IIJA)Personal Protective Equipment (PPE) Indefinite Delivery/Indefinite Quantity (IDIQ) contracts is an acquisition vehicle available to all Institutes and Centers (ICs) and offices within the NIH and DHHS OPDIVs. This multiple award twelve (12) vendors will be utilized by NIH and DHHS to procure IIJA compliant PPE.

In technical terms the, the IIJA PPE vehicle is an Indefinite Delivery/Indefinite Quantity contract which affords customers the ability to order Made in America personal protective equipment after requirements materialize, providing NIH with the flexibility in both quantities and delivery schedule.

Background

On November 15, 2021, the Infrastructure Investment and Jobs Act (Pub. L. 11758) was signed into law. Subtitle C of title IX of Division G, the Make PPE in America Act (Act), requires the Department of Homeland Security (DHS), Department of Veterans Affairs (VA), and the U.S. Department of Health and Human Services (HHS) to take certain actions to ensure the sustainment and expansion of personal protective equipment manufacturing in the United States and meet the needs of the current pandemic response.

Make PPE in America ACT, sec .70953: Requirement of long-term contracts for domestically manufactured personal protective equipment. Any contract for personal protective equipment (PPE) awarded by the Department of Homeland Security, the Department of Health and Human Services (HHS), or the Department of Veterans Affairs would have a minimum length of two years. The measure would require the products to be made in the U.S., except in limited circumstances. The bill would also allow the transfer of excess PPE from HHS to the Strategic National Stockpile (SNS), and allow for the sale of drugs, vaccines, medical devices, or other supplies from the SNS during a public health emergency (PHE).

The term personal protective equipment means surgical masks, respirator masks and powered air purifying respirators and required filters, face shields and protective eyewear, gloves, disposable and reusable surgical and isolation gowns, head and foot covering, and other gear or clothing used to protect and individual from the transmission of disease.
